Terms of service

1. Purpose and scope

1.1 Rue de Garennes srl, with its registered office at Avenue Armand Huysmans 94, 1050 Ixelles (Belgium), registered with the Crossroads Bank for Enterprises under number 0696.994.092 (VAT BE 0696.994.092) (the "Seller"), sells fashion clothing and accessories (the "Products") on its website ruedegarennes.com (the "Website").

1.2 These terms and conditions of sale (the "Terms") govern the use of the Website and the sale of Products by the Seller.

1.3 The Client is invited to read them carefully before ordering. Any order for a Product (the "Order") requires that they have been read and expressly accepted. By confirming the Order, the Client agrees to be bound by the Terms; confirming the order form constitutes an electronic signature.

1.4 By placing an Order, the Client declares that they have full legal capacity to do so. The Terms apply to consumers, i.e. individuals acting for private purposes. They exist in French and in English; the French version prevails.

2. Definitions

In these Terms:
Shop means the Seller's shop at Rue de l'Église 96, 1150 Brussels (Stockel);
Client means any adult individual acting as a consumer, outside their professional activity, who places an Order on the Website;
Gift Card and Discount Code have the meaning given in clause 3bis;
Order Confirmation has the meaning given in clause 5.3;
Force Majeure means any unforeseeable and unavoidable event beyond the Seller's control that delays or prevents the performance of its obligations (including supply interruptions, carrier delays or strikes, civil unrest, decisions of a public authority);
Delivery and Delivery Address have the meaning given in clause 7.1.

3. Description and availability of the Products

3.1 The Products offered are those shown on the Website when it is consulted, while stocks last. Each Product comes with a description of its main characteristics (fabric, cut, measurements where given) and one or more photographs. The Seller takes care that they are accurate; colours may however vary slightly from one screen to another.

3.2 Products come in small quantities and are also sold in the Shop. If an ordered Product is no longer available, the Seller informs the Client without delay and offers to change or cancel the Order; if the Order is cancelled, any amount paid is refunded within 14 days at the latest.

3.3 The Seller may withdraw a Product from sale or change the content of the Website at any time, without affecting Orders already confirmed.

3bis. Gift cards and discount codes

3bis.1 The gift card sold on the Website is an electronic card sent by email. It is valid for 2 years from purchase and can be used on the Website only. Its balance carries over from one order to the next until it is used up or expires. It cannot be refunded or exchanged for cash.

3bis.2 Physical gift cards sold in the Shop can be used in the Shop only and are subject to their own conditions, stated on the card. They are not accepted on the Website.

3bis.3 A Discount Code is entered at checkout. Its conditions (amount, validity period, single or multiple use, whether it can be combined with other discounts) are stated when it is sent and applied automatically by the Website. It cannot be exchanged for cash, nor applied retroactively to an Order already paid. An expired code is not replaced.

3bis.4 Once a gift card has been used, even partly, it can no longer be withdrawn from.

4. Prices

4.1 Prices are shown in euros, including all taxes (VAT included), excluding delivery costs. Delivery costs are shown separately, before the Order is confirmed.

4.2 The Seller may change its prices and delivery costs at any time; the price that applies is the one displayed on the Website at the time of the Order.

4.3 The Seller only delivers within the European Union (clause 7.2): no customs duties or import taxes are charged on delivery.

5. Orders

5.1 The Client provides on the order form the necessary information (first name, last name, billing and delivery address, email address) and makes sure it is accurate.

5.2 By clicking the payment button, the Client confirms the Order and undertakes to pay the total price, including delivery costs and less any discounts.

5.3 The Seller confirms each Order by an email summarising the date, the Products, the price and the delivery method (the "Order Confirmation"). The contract is concluded when this confirmation is sent.

5.4 The Seller may refuse or cancel an Order in the event of an obvious pricing error, a previous payment dispute with the Client or a refused payment authorisation; any amount paid is then refunded without delay.

6. Payment

6.1 The total price is paid online when the Order is placed.

6.2 Payment is made using one of the methods offered on the checkout page (including Bancontact, credit cards, Klarna and express payment). Payment data is processed by a secure payment provider; the Seller never has access to it.

6.3 The Client warrants that they are entitled to use the chosen payment method. If payment is not authorised, the Order is not processed.

7. Delivery and receipt of the Products

7.1 Products are delivered to the address or pick-up point given by the Client when ordering (the "Delivery", the "Delivery Address"). Depending on stock availability, an Order may be delivered in several shipments.

7.2 The Seller delivers to Belgium, France and the Netherlands, by Mondial Relay, bpost or DPD, or any other carrier of its choice. Methods, times and rates are set out on the Delivery & returns page:

  • Belgium: Mondial Relay pick-up point €4, home delivery by bpost €7, free from €85; free collection from the Shop;
  • France: Mondial Relay pick-up point €4, home delivery by DPD €9, free from €85;
  • the Netherlands: home delivery by DPD €12, free from €150.

7.3 The Seller ships the Order within 24 working hours of its confirmation. It then reaches the Client within 2 to 5 working days depending on the destination and the method chosen; during collection launches, allow an extra day or two. These times are indicative; in any event the Seller delivers no later than 30 days after the Order, failing which the Client may cancel the Order and be refunded.

7.4 If delivery is more than seven days late compared with the announced time, the Client is invited to contact the Seller, who opens an investigation with the carrier. If the parcel is lost, the Seller sends the Product again at its own expense if it is still available, or refunds the Client.

7.5 For collection from the Shop, the Client receives an email inviting them to collect the Order during opening hours. It is kept for 14 days. After that, the Client is invited to contact the Seller (info@ruedegarennes.com, +32 472 69 69 30) to arrange a new collection or a shipment.

7.6 An incorrect Delivery Address is the Client's responsibility and may lead to additional costs.

7.7 Risk passes to the Client upon Delivery. If the parcel arrives opened or damaged, the Client reports it to the Seller as soon as possible, by email, with a photo.

8. Right of withdrawal and returns

8.1 The Client has 14 calendar days from the day after Delivery to inform the Seller that they withdraw from the contract, without giving any reason and without penalty. This right also applies to Orders collected from the Shop.

8.2 The Client exercises this right from their customer account on the Website, by email to info@ruedegarennes.com, or using the withdrawal form below. The practical arrangements are set out in the refund policy.

8.3 The Client sends the Products back no later than 14 days after informing the Seller of the withdrawal. Products must be returned unworn, unwashed, with their original tags; the Client is liable for any loss in value resulting from handling beyond what is needed to try them on.

8.4 Returning the Products by carrier costs €4, deducted from the refund: returns are made by bpost from Belgium, and by DPD from France and the Netherlands. Products brought back to the Shop are returned free of charge. Nothing is deducted for a defective or non-conforming Product (clause 9), however it is returned.

8.5 The Seller refunds the Client no later than 14 days after receiving the Products, to the payment method used for the Order. If the Client returns the whole Order, the delivery costs paid are refunded up to the cheapest standard delivery method. The amount refunded cannot exceed what the Client paid.

8.6 The Seller does not offer exchanges: for another size or another piece, the Client places a new Order and returns the one that does not suit.

8.7 The right of withdrawal does not apply to Products made to the Client's specifications or clearly personalised.

9. Legal guarantee

9.1 All Products are covered by the two-year legal guarantee of conformity from Delivery. The Client informs the Seller of any defect within two months of discovering it.

9.2 For a faulty Product or one that does not match its description, the Client writes to info@ruedegarennes.com with the Order number and a photo. The Seller takes the Product back at its own expense, then repairs it, replaces it or refunds the Client.

10. Personal data

The Seller processes the Client's personal data in accordance with its privacy policy, which describes the data collected, its purposes, its recipients and the Client's rights.

11. Intellectual property

The elements of the Website (texts, photographs, visuals, logos) are the exclusive property of the Seller and are protected by intellectual property law. Any reproduction, in whole or in part, without the Seller's prior written consent is prohibited.

12. Liability and force majeure

12.1 The Seller is not liable for damage resulting from temporary unavailability of the Website, nor for damage caused to the Client's equipment by an external element (such as a virus), unless it is at fault.

12.2 The Seller is not liable for non-performance due to Force Majeure. It informs the Client as soon as possible. If Force Majeure lasts more than one month, the Order is cancelled and the Client refunded.

13. Severability and entire agreement

13.1 If any clause of these Terms is held invalid or unenforceable, the other clauses remain in force.

13.2 These Terms, together with the Order Confirmation and the documents they refer to (refund policy, Delivery & returns page, privacy policy), constitute the entire agreement between the Client and the Seller.

14. Governing law, disputes and mediation

14.1 These Terms and any Order placed on the Website are governed by Belgian law, without depriving the Client of the protection afforded by the mandatory provisions of the law of the country where they live.

14.2 In case of difficulty, the Client first contacts the Seller (info@ruedegarennes.com). Failing agreement, they may refer the matter free of charge to the Belgian Consumer Mediation Service (Boulevard du Roi Albert II 8 box 1, 1000 Brussels, mediationconsommateur.be).

14.3 Any dispute falls within the jurisdiction of the competent Belgian courts, in accordance with the statutory rules; a consumer Client retains the right to bring proceedings before the courts of their place of residence where the law allows.
